Terms of Service

Welcome to Table Top Swap. These Terms govern your use of the Table Top Swap application and website (together, the “Platform”), operated by Table Top Swap LLC (“TTS,” “we,” “us”). By creating an account you agree to these Terms and to our Privacy Policy.

1. Eligibility

You must be at least 18 years old to create an account or use the Platform. By creating an account you confirm that you are 18 or older. We may suspend or terminate any account we believe belongs to someone under 18.

The Platform operates in the United States only. You must have a valid United States shipping address to send or receive an exchange, and shipments are made within the United States. We may suspend or terminate any account we believe is being used from outside the United States.

2. What Table Top Swap Is

Table Top Swap is a venue where members offer their own tabletop games, puzzles, and similar items for exchange with other members, and where the exchange is arranged, paid for, and shipped through tools we provide.

TTS is not a buyer, seller, broker, carrier, insurer, escrow agent, or party to any exchange between members. Members are responsible for their own listings, the accuracy of their descriptions, the condition of what they send, packing their items, and the outcome of their exchanges. Title to an item passes directly between the members involved and never to TTS.

3. Your Responsibilities

You agree that you will:

  • own the items you list, and have the right to trade them;
  • describe each item accurately, including its condition, completeness, and any damage, using the condition standards published in the app;
  • send the item you agreed to send, packed adequately, within the timeframe stated in the app;
  • treat other members civilly, and use the Platform’s tools rather than working around them; and
  • keep the shipping address on your account current and accurate.

You acknowledge that your shipping address and name are shared with the member you are exchanging with, and with our shipping and payment providers, because an exchange cannot be completed otherwise.

4. Prohibited and Restricted Items

The Platform is for tabletop games, card games, party games, puzzles, and directly related items. Listing anything else is prohibited, as is listing anything illegal, counterfeit, recalled, unsafe, or that you do not own. The current list of prohibited and restricted items is published in our Community Guidelines and forms part of these Terms. We may remove any listing that violates it, with or without notice.

5. Fees, Payments, and Shipping

Fees. Joining the Platform and listing items are free. When you accept an exchange, you pay the cost of the shipment coming to you plus a flat platform fee. The full amount is shown to you before you confirm, and no charge is made without that confirmation.

Fee changes. We may change the platform fee at any time. A change applies only to proposals created after it takes effect; a proposal already in progress keeps the fee it was created with.

Payments. Payments are processed by a third-party payment processor. We do not store your full card details.

Shipping. Shipping labels are purchased through a third-party shipping provider and carriage is performed by independent carriers. We are not responsible for carrier performance, delays, loss, theft, or damage in transit, and nothing in Section 6 changes that.

Returned shipments. A shipment that cannot be delivered may be returned to its sender. This is separate from carrier loss or damage, and the swap terms you accept at checkout describe what happens next.

Lost packages and insurance claims. Shipping labels issued through the Platform include carrier insurance, currently up to $100 per package. Because we purchase the label, we may file a claim with the carrier when a package is reported lost. We are not obliged to file a claim, and filing one does not guarantee a payout — the carrier decides whether a claim succeeds and how much it pays.

Where a claim is paid, we may pass the recovery to the member who did not receive their item. Any such payment is at our discretion, is limited to what the carrier actually pays us, and is separate from the refund limits described in Section 6.

Carrier claims take time, often several weeks. We may refund the amounts we collected before a claim is decided, but we are not required to.

Insurance covers the carrier’s liability for the package. It does not make either member whole for an item that cannot be replaced, and it is not a guarantee against loss.

6. Disputes Between Members, and What We May Do

If an exchange goes wrong, you may open a dispute in the app. We may, at our sole discretion, review that dispute and take one or more of the following actions: refund some or all of the amounts we charged you; issue a Platform credit; issue a strike, suspension, or ban against a member; or close the dispute without action.

The following limits apply and are important:

  • Any refund is limited to amounts TTS actually collected from you — that is, the shipping you paid for and the platform fee. We do not compensate members for the value of an item, for its replacement cost, or for any loss beyond what we charged.
  • Platform credits are a discretionary accommodation, are capped, have no cash value, and expire or are forfeited if your account is terminated.
  • Any action we take is a discretionary accommodation and not an admission of liability, not a guarantee of any outcome, and not a warranty of any exchange.
  • We are not an arbitrator of, or a guarantor of, exchanges between members. Our review is an operational service we choose to provide; it does not make us a party to your exchange, and it does not limit your ability to pursue the other member directly.

Deciding a dispute in one way does not oblige us to decide a similar dispute the same way.

7. Reports, Moderation, and Enforcement

We provide tools to report members, listings, photos, and exchanges. You acknowledge that reports, listings, reviews, photos, support messages, and other content submitted through the Platform may be reviewed by us when necessary to investigate suspected violations, respond to a report, protect members, or comply with a legal obligation.

We may issue warnings, remove listings or photos, restrict features, issue strikes, suspend accounts, or permanently ban members. Accounts reaching a defined number of active strikes are suspended automatically.

8. Right to Refuse Service

We may refuse service, decline to create an account, remove content, restrict access, or suspend or terminate an account at any time, for any reason permitted by law.

9. Account Deletion and Data

You may delete your account in the app or by contacting support. Deletion may be delayed where you have an exchange in progress. Some information is retained after deletion where we are legally required to keep it or where it is reasonably necessary for tax records, fraud prevention, dispute records, or payment-processor requirements. 10. Assumption of Risk

You acknowledge the risks inherent in a peer-to-peer marketplace, including misrepresentation, fraud, disputes about condition, shipping problems, and financial loss. You accept those risks.

11. Disclaimers

The Platform is provided “as is” and “as available.” To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, secure, or error-free, that catalog information is accurate, or that any member will behave as they say they will.

12. Limitation of Liability

To the fullest extent permitted by law, TTS is not liable for the conduct of any member, for any exchange or its outcome, for misrepresented or damaged items, for payment or shipping problems, or for any indirect, incidental, special, consequential, or punitive damages.

Our total liability to you for any claim will not exceed the greater of (a) the fees you paid to TTS for the exchange giving rise to the claim, or (b) fifty US dollars ($50).

Some jurisdictions do not allow certain exclusions or limitations, so parts of this section may not apply to you.

13. Indemnity

You agree to indemnify and hold harmless TTS and its officers and agents from claims, losses, and expenses arising out of your listings, your exchanges, your content, or your breach of these Terms.

14. Changes to These Terms

We may amend these Terms. When we do, we will update the date above and, for material changes, notify you in the app or by email. Continuing to use the Platform after a change takes effect means you accept the amended Terms.

15. Governing Law and Disputes with TTS

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute between you and TTS will be brought exclusively in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.

16. General

If any provision of these Terms is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. These Terms, together with the Privacy Policy and the Community Guidelines, are the entire agreement between you and TTS regarding the Platform.
